05Common questions
Which inheritance law applies to my family?
It depends mainly on the religion of the deceased and the heirs. Islamic inheritance is handled by the religious court, while civil inheritance is handled by the district court. Customary law can also play a role. We will confirm which applies in your case.
Do I need a will?
It is not mandatory, but a will made before a notary helps avoid disputes and makes your wishes clear. Under Islamic law, a bequest to people who are not heirs is generally limited to one third of the estate.
Can an estate be divided without going to court?
Yes. If all heirs agree, the estate can often be settled through an agreement and the relevant heirship documents, without litigation.
